(1) Any person who violates this Act by not accepting the Preliminary Environmental Test, Brief Environmental Study or Environmental Impact Assessment Report or implements a proposal contrary to the approved report or commits or intends to commit an act contrary to this Act may submit a petition to the relevant agency or authority.
(2) If any person commits pollution or discharges a hazardous substance contrary to this Act or the rules, guidelines or standards made under this Act or causes any harm to any person, organization or local community due to any accidental pollution, the person, organization or local community suffering from such act shall He can file an application to get compensation before the relevant agency for the damage he has suffered.
(3) If it is determined that the petitioner has suffered a loss during the investigation and investigation in relation to the petition made under sub-section (1) or (2), the person, organization or proposer shall pay reasonable compensation to the affected person, organization or local community after ascertaining the loss.
(4) A committee consisting of three experts nominated by the Government of Nepal will be formed to investigate the petition regarding pollution caused by an agency of the Government of Nepal or an organization owned and controlled by the Government of Nepal, and based on the recommendation of the committee, compensation shall be paid in accordance with sub-section (3).
(5) A committee consisting of three experts nominated by the provincial government will be constituted to investigate the petition regarding pollution damage caused by the state government or any agency of the state government or the local level or an organization owned and controlled by the state government or the local level, and based on the recommendation of the committee, sub-section (3) Compensation should be paid accordingly.
(6) The basis for determining compensation and other arrangements shall be as prescribed in accordance with this section.
